Article 2 – Scope of Application
1. These General Terms and Conditions apply to each offer between Comptoir des Vins and the consumer (any natural person who acquires or uses for purposes excluding any professional the products or services placed on the market and who enters into a distance contract with Comptoir des Vins).
2. The delivery address provided by the Buyer must be located in Belgium. We do not deliver outside of this country.
3. In order to place an order, you must be at least 18 years old. If you are not 18 years old, we ask you to consult your parents or guardian before placing an order.
4. By using the Comptoir des Vins website and/or placing an order there, you accept these General Terms and Conditions as well as all rights and obligations as mentioned on our website.
5. In the event that, in addition to these General Terms and Conditions, specific conditions apply, the above also applies to these specific conditions. In the case of conflicting General Terms and Conditions, the consumer may always invoke the applicable provision that is most favourable to them.
Article 3 – Offers & Birth of Contracts
1. If an offer is valid for a limited period or is subject to conditions, this is always expressly mentioned in the offer.
2. Our offer contains a complete and accurate description of the products offered and the ordering method. The description is detailed enough to allow you to properly assess the offer. If we use illustrations, these are a faithful representation of the products offered.
3. Your order will be complete and the contract is formed as soon as we have confirmed your order by email and as soon as we have received approval of your transaction from your credit or debit card issuer. We accept the following payment methods: Bancontact / Visa / Mastercard. We are not responsible for delays in delivery and/or non-delivery of your order if these delays are due to the refusal of your payment by your card issuer. No order is accepted or processed without valid payment in the name of the (registered) cardholder.
4. To purchase a product, you add it to your basket. Then, you fill in the form with your personal details as well as your billing information and you choose your delivery method. In the final step of the ordering process, you will then see a summary page where you will be asked to accept our General Terms and Conditions.
Article 4 – Right of Withdrawal
1. For any wine order, you have a period of 14 calendar days from the delivery or conclusion of the contract to withdraw from the contract. During this time you can return your order without penalty and without giving a reason (the return costs are at your expense). Within 14 days of the return of your order or the termination of the contract, we will refund you the full purchase price, using the same payment method that the consumer used for the initial transaction.
2. The return costs are therefore at your expense. We will indicate the exact cost for this return or provide an estimate, if it is impossible to predict the exact cost. In the event that it is not possible to return the goods by post, we will collect the goods at our own expense.
3. We may defer the refund until the effective date of total recovery of your order.
4. During the withdrawal period, we advise you to handle the wines and packaging with care, and to only unpack or use them to the extent necessary to assess whether you wish to keep them.

Article 5 – Price
1. During the validity period mentioned in the offer, the prices of the wines offered are not increased, except for price changes resulting from changes in VAT and excise rates.
2. Our prices include all taxes, duties and services. There will therefore never be any surprises for you. However, we may decide to charge you for delivery costs. In this case, we will notify you before confirming your order.
Article 6 – Payment
1. Payment is limited to the payment methods offered on our Website.
2. To ensure secure online payment and guarantee the security of your personal data, transaction data is encrypted with SSL technology sent over the net. To pay with SSL, you do not need special software. You recognise a secure SSL connection by the ‘lock’ present in the status bar of your browser.
Article 7 – Compliance & Guarantee
We guarantee that our products comply with your order and meet the normal expectations you may have considering the product specifications. We also guarantee that our products comply with all existing laws at the time of your order.
Article 8 – Delivery & Execution
1. Deliveries are made to the delivery address provided at the time of your order.
2. If the ordered product is in stock, we aim to deliver within 1 to 4 working days. Items that are not in stock are delivered within 6 to 10 working days. We will inform you of the delivery date in your order confirmation.
3. If we cannot deliver on time, we will always inform you before the scheduled delivery date. If we do not inform you in time, you have the right to cancel your order at no cost. In this case, we will refund you within 30 days of the cancellation.
4. The dispatch of your order always takes place at our risk, so you should never worry about potential loss of goods in the post. The return of goods that you send back to us within 14 days of purchase because you do not wish to keep them is always at your own risk.
5. If the goods delivered by us have been damaged during transport, do not match the items listed on the delivery note, or do not correspond with the items you ordered, you must inform us as soon as possible, and no later than within 3 days, and you must then return the items in question to us within 14 days of receipt.
For this purpose, you must use the return form that you will find in the packaging of your order.
Article 9 – Force majeure
1. In the event of force majeure, we are not obliged to fulfil our obligations to the other party. In this case, we have the right to suspend our obligations for the duration of the force majeure, or to permanently cancel your order.
2. Force majeure means any circumstance beyond our control whereby the fulfilment of our obligations to you is wholly or partially impossible. These circumstances include, among others: strikes, lock-outs, labour disputes, fire, technical incidents, power outages, disruptions in networks, lines (of telecommunications) or communication systems used and/or the unavailability of our website, absence of delivery or late delivery by suppliers or other third parties, and the failure to obtain an authorisation to receive from the authorities.
Article 10 – Ownership of files
All data on this site (images, texts, graphics, logos) are protected by copyright.
Article 11 – Complaint Procedure
1. We obviously always hope that all our customers are 100% satisfied.

2. Belgian law exclusively applies to all contracts with our customers, regardless of their place of residence. All disputes related to or arising from the offers of Comptoir des Vins are subject to the exclusive jurisdiction of the Belgian courts and tribunals. If, for reasons of international law, another law would still be applicable, it will be interpreted primarily in accordance with Belgian law regarding market practices and consumer protection.
3. The mediation service of SPF Economy is competent to receive any request for extrajudicial resolution of consumer disputes. Either the mediation service for the consumer handles the request itself, or it forwards the request to a qualified entity for processing.
Article 12 – Personal Data Protection
In accordance with regulation 216/679 of the European Parliament of 27 April 2016, you have the right to access, modify, rectify, and delete data concerning you.
